I respect the intellectual property of others and expect the same from everyone I work with. If you believe material on this website infringes your copyright, you can ask me to remove it using the process below. It follows the United States Digital Millennium Copyright Act (DMCA). As a Canadian business, I also review notices under the Copyright Act of Canada.

Sending a takedown notice

Email your notice to luis@luisfederici.com with "DMCA notice" in the subject line. To be valid, it must include:

your physical or electronic signature (typing your full name is enough);
a description of the copyrighted work you believe has been infringed;
the exact URL or location on this site of the material you want removed;
your name, postal address, telephone number and email address;
a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on their behalf.

What happens next

When I receive a complete notice, I will review it and, if it is valid, remove or disable access to the material promptly. I will let the person who supplied the material know, and send them a copy of your notice so they can respond.

Sending a counter-notice

If material you supplied was removed and you believe that was a mistake, you can send a counter-notice to the same email address. It must include:

your physical or electronic signature;
a description of the material that was removed and where it appeared before removal;
a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification;
your name, address and telephone number;
a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which I may be found), and that you will accept service of process from the person who sent the original notice.

If I receive a valid counter-notice, I will forward it to the person who sent the original notice. Unless they tell me within 10 to 14 business days that they have filed a court action, I may restore the material.

Websites I built for clients

Websites I build are owned and controlled by my clients, not by me. If your concern is about content on one of their sites, please contact the site's owner or hosting provider directly. If you are not sure who that is, email me and I will pass your notice on to the owner.

Repeat infringers

I will stop working with any client or collaborator who repeatedly supplies infringing material.

False claims

Under section 512(f) of the DMCA, anyone who knowingly makes a false claim that material is infringing, or that it was removed by mistake, may be liable for damages. If you are unsure whether something infringes your rights, consider getting legal advice before sending a notice.
