End User License Agreement

This agreement covers two things: using this website, and the websites I design and build for clients. "I" and "me" means Luis Federici, an independent web designer based in Stratford, Ontario, Canada. "You" means anyone visiting this site or working with me. By using this site or accepting a website from me, you agree to these terms.
Part 1: Using this website
Your licence
You may view and use this website to learn about my services and to contact me. This is a personal, non-exclusive licence that I can withdraw at any time.
What you may not do
- Copy, resell or republish this site's design, code, text or images as your own.
- Scrape the site, or use automated tools that put unreasonable load on it.
- Send spam, malware or misleading information through the contact form.
- Try to break into, disrupt or test the security of the site without my written permission.

The projects in "Recent work" belong to the businesses they were made for. Their names, logos and content are theirs and are shown with permission as examples of my work.
Part 2: Websites I build for you
You own your website
Once your website is delivered, you own the custom code, design and written content I created for you, and you are free to change, move or hand it to someone else. Your domain is registered in your name, not mine. No lock-in.
Third-party parts
Websites often include parts made by others, such as fonts, open-source code libraries, icons, maps or stock photos. You receive these under their own licences, not this one. I only use parts whose licences allow commercial use, and I will tell you if any of them need an account or subscription in your name.
Your content
You are responsible for making sure you have the right to use the text, photos, logos and other material you give me. You keep ownership of it, and you allow me to use it only to build and support your site.
Portfolio
You allow me to show your finished website, its name and screenshots in my portfolio and on this site. If you would rather I didn't, tell me and I will remove it.
Free websites
While my limited-time offer runs, I design and build selected websites at no charge. You still pay for your own domain, and for hosting or other services if you choose ones that charge a fee. I may end the offer or decline a project at any time. Work already agreed in writing will be completed.
After launch
I am happy to help with changes after launch, but I am not obliged to provide ongoing maintenance, hosting, backups or updates unless we agree to that in writing. Once your site is live, keeping your domain renewed and your accounts secure is up to you.
Written agreements come first
If we sign a separate proposal or contract for your project, it takes priority over this page wherever the two differ.
Part 3: For both
No warranty
I work hard to build fast, reliable websites, but this site and the websites I deliver are provided "as is". I do not guarantee that they will always be available, free of errors, or reach any particular search ranking or number of customers.
Limitation of liability
To the extent the law allows, I am not liable for indirect or consequential losses, such as lost profits, lost data or business interruption, arising from this site or a website I built. My total liability for any claim is limited to the amount you paid me for the work in question in the 12 months before the claim. Nothing in this agreement limits liability that cannot be limited by law.
Governing law
This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, unless the law where you live gives you the right to use your local courts.
Changes
I may update this agreement from time to time. The date at the top shows the latest version. Changes do not affect work already agreed in writing.
